REGULATIONS
We would like to kindly inform you that some of the regulations have changed. Please read the changes.
The new regulations entering into force on 15-04-2020 are available below.

General provisions
    1. The Regulations set out the rules for using the questsport.cc online store for placing orders, delivery and payment methods, the Customer's rights to cancel an order and withdraw from the contract, as well as to submit and consider complaints.
    2. Questsport Ewa Włoszczowska conducts retail sales via the Internet. Orders are accepted only through websites available in the domain questsport.cc. To use, browse the assortment, as well as place orders in the questsport.cc store, you need a computer with Internet access and a web browser, e.g. Internet Explorer, Google Chrome, Mozilla Firefox, Opera, Safari and an active e-mail account (e-mail ).

3. Customers have the option of making purchases through questsport.cc by registering and thus creating an account in which data and information about the Customer regarding his activities in the questsport.cc store are collected. The customer has the right to terminate the contract concluded with Questsport Ewa Włoszczowska regarding the account, at any time by sending an e-mail with this instruction to the address: sklep@questsport.cc. The above does not apply to situations in which Questsport Ewa Włoszczowska is in the process of completing the order placed by the client. In such a case, the effect of termination of the contract will occur upon completion of the contract. Provision of services under the Account on questsport.cc is indefinite.

4. All products offered in the questsport.cc store are brand new, free from physical and legal defects, and have been legally placed on the Polish market. Products other than new ones have clearly defined this in the product description.

5. All products have a manufacturer’s, importer’s or seller’s warranty in Poland. Detailed conditions for the implementation of the guarantee are set out in the printing guarantee issued by the guarantor.

6. Detailed technical data are included in the product specification (description). In the event of a discrepancy, disputes related to the descriptions and photos will be resolved in favor of the customer.

7. The order will be processed provided that the product is available in the warehouse or at the store’s suppliers. In case of unavailability of some of the goods covered by the order, the customer is informed about the status of the order (e-mail or telephone) and decides how to implement it (partial implementation, extension of waiting time, cancellation of the entire order).

8. Ordered goods that we do not have in stock are sent after completing the entire order. In the event of a change or extension of the delivery time, the customer will be notified of a delay in delivery. In such a situation, he may agree to a new delivery date or withdraw from the contract.

When placing an order, please remember that:

9. Delivery time: Shipments are delivered by UPS and InPost courier companies on the next business day after shipment, Parcel lockers up to 3 business days.

10. Products in the sale section are in limited quantities. Orders are carried out in the order in which orders are received for these goods, until the stocks covered by this form of sale are exhausted.

11. All prices given in the store are gross prices, for each purchased product a receipt is issued or a VAT invoice on request.

12. We try to make orders placed by 12:00 on a weekday are processed and sent the next day.

13. Payments for orders are made as follows:

14. The customer who has chosen the option of payment by bank transfer is obliged to pay the fee for the order placed within 5 business days of placing the order. Otherwise, Questsport Ewa Włoszczowska’s offer is not binding and the order may be canceled. Payment title should only include the order number. It is possible to extend the payment deadline by informing the store service about this fact.

15. We deliver ordered goods via courier companies UPS and InPost and Parcel Lockers. Delivery costs are available when choosing the delivery method.

16. The customer always has the right to open the package in the presence of the courier. We suggest checking the condition of the package’s packaging, and in case of visible damage, not picking up the package or opening the package in the presence of the courier. In this situation, the courier should write a report on the basis of which the complaint will be considered.

Please inform us about the situation and send us a scan / photo of the damage report, it will help us to collect compensation from the courier company. However, please remember that in the event of any damage or irregularities, we will make every effort to ensure that a new product, free from defects, appears at your place as soon as possible.

17. In the case of personal pickup from Questsport magazine, Ewa Włoszczowska informs about the possibility of picking up the ordered product questsport.cc by e-mail. The parcel should be picked up within 5 days of receiving information about the option of receiving the product. An order which is not picked up within the time limit will be canceled.

18. For some types of assortment available at questsport.cc, Questsport Ewa Włoszczowska reserves the right to limit the method of delivery / payment by not providing certain payment and delivery options.

19. If the order exceeds PLN 5,500, partial or full prepayment is required. This is due to the fact that the courier does not support the payment on delivery service above the above amount.

20. The contract concluded between the Customer and Questsport Ewa Włoszczowska regarding the purchase of a given product is timely and lasts for the duration of the order. The place of fulfillment of the benefit related to the purchase of products at Questsport Ewa Włoszczowska is the delivery address indicated by the Customer, except for products collected personally by the Clients, where the place of performance is the collection point from Questsport Ewa Włoszczowska

21. Orders of customers who do not answer questions of store employees (customer panel or electronic correspondence) for a period of 5 days will be considered invalid, and orders will be canceled.

After we receive the goods from the guarantor, we will immediately inform you about our receipt of the goods from the guarantor and about the actions taken by the guarantor, and we will send the goods to the goods you specify. The cost of returning repaired / replaced goods is borne by Questsport Ewa Włoszczowska.

Warranty

We are responsible under the warranty on the principles set out in the Civil Code.

1. Questsport Ewa Włoszczowska is liable under the warranty if a physical defect is found within two years from the date of delivery of the item to the Customer.

2. If you prefer to exercise your rights under the warranty, we encourage you to complete the complaint form available on our website. Use will facilitate communication and significantly speed up the handling of complaints. In the notification made under the warranty, please state clearly what you are demanding and describe what the reported defect is. If the complaint is accepted, the cost of returning the goods is returned to the Customer, and re-delivery is at the expense of Questsport Ewa Włoszczowska

If the Good has a defect, the Customer may submit a statement on price reduction or withdrawal from the contract, unless Questsport Ewa Włoszczowska immediately replaces the defective Good with a free from defects or removes the defect. This limitation does not apply if the Good has already been replaced or repaired by the Seller or the Seller failed to satisfy the obligation to replace the Good with a good free from defects or to remove the defect.

6. If the Product has a defect, the Customer may also request replacement of the item for one free of defects or removal of the defect.

7. 8. The customer may not withdraw from the contract if the defect is irrelevant.

9. We will respond to your request within 14 days, informing you whether we accept it or not. No response within this period means that we have deemed your claim justified.

10. If we recognize your claims, we will immediately proceed to remove the defect in the manner you specify.

11. We do not limit the consumer’s rights under the law in Poland in any way.

12. Complaints about goods are dealt with within 14 days, during which Questsport Ewa Włoszczowska undertakes to inform the Customer about the acceptance or rejection of a complaint. If the case requires additional technical expertise carried out by external companies, this period may be extended to 21 days.

13. All disputes related to the services provided by Questsport Ewa Włoszczowska as part of questsport.cc will be settled by common courts.

14. Each customer may use out-of-court complaint and redress methods. In this regard, it is possible for the client to use mediation. Lists of permanent mediators and existing mediation centers are forwarded and made available by the Presidents of relevant District Courts. The Customer who is a Consumer may also use extrajudicial means of dealing with complaints and redress by submitting his complaint via the EU ODR online platform, available at: http://ec.europa.eu/consumers/odr/
